Vehicular Assault Defense in Nassau County
Former-Prosecutor Analysis for Impaired-Driving Injury Charges
Vehicular assault allegations raise questions about the claimed injury, chemical testing, and the cause of the crash. At Lerner & Lerner, P.C., we apply former-prosecutor analysis to each part of the accusation, recognizing that these cases involve more than an ordinary DWI charge.
Our firm is led by Richard Lerner and Kimberly Lerner, a father-daughter team of former prosecutors with over 70 years of combined legal experience. We develop defense strategies for people facing felony charges, misdemeanor charges, and DUI/DWI allegations throughout Nassau County.

What New York Vehicular Assault Charges Require
Vehicular assault generally involves causing serious physical injury while operating a motor vehicle in violation of specified intoxication or impairment provisions. A DWI charge concerns the driver’s condition and operation of the vehicle. Vehicular assault adds the allegation that another person suffered an injury meeting New York’s statutory threshold.
That threshold can include an injury creating a substantial risk of death, serious and protracted disfigurement, protracted impairment of health, or protracted loss or impairment of an organ’s function. An injury crash doesn’t automatically satisfy the standard. The medical evidence and the connection between the alleged conduct and the injury require careful review.
Degrees of Vehicular Assault in New York
The degree charged affects the potential incarceration exposure and the issues the defense must address. A statutory maximum isn’t a prediction of the sentence in a particular case. The allegations, evidence, prior record, and court outcome all matter.
New York recognizes the following charge levels:
- Vehicular Assault in the Second Degree: This class E felony carries potential maximum incarceration of up to four years.
- Vehicular Assault in the First Degree: This class D felony carries potential maximum incarceration of up to seven years.
- Aggravated Vehicular Assault: This class C felony carries potential maximum incarceration of up to 15 years.
First-degree vehicular assault requires the elements of second-degree vehicular assault plus an aggravating factor. Examples include an alleged blood alcohol concentration of .18 or higher, a qualifying prior DWI or DWAI conviction within the preceding 10 years, or serious physical injury to a passenger who is 15 or younger. A qualifying out-of-state license suspension or revocation can also be relevant.
Aggravated vehicular assault involves reckless driving combined with second-degree vehicular assault and additional aggravating circumstances. Potential fines and other financial consequences require charge-specific review rather than assumptions based only on the felony classification.
Building a Vehicular Assault Defense in Nassau County
Early review allows us to identify evidence that may change, disappear, or become more difficult to obtain. When appropriate, we prioritize pre-arrest intervention by gathering evidence, interviewing witnesses, and consulting qualified professionals.
We examine the basis for the traffic stop and arrest, as well as how breath or blood testing was administered. Our review can also address breath-test challenges, sobriety-test evaluations, crash evidence, identity, and whether the prosecution can prove the alleged serious physical injury and its cause.
Our broader assault-defense investigations consider provocation, lawful self-defense, mistaken identity, and possible motives to fabricate when those issues bear on the allegations. We shape the strategy around the circumstances and available evidence.
Information that can assist an initial evaluation includes:
- Charging papers, release documents, and court notices
- Breath-testing, blood-testing, or other test-related records
- Crash reports, photographs, and available medical or insurance documents
- Names of witnesses and a written account of events while the details remain fresh
Keep these materials together, and avoid discussing the allegations with anyone other than legal counsel. Statements to friends, witnesses, or online audiences can become evidence in the prosecution.
Felony Proceedings & Driver’s License Concerns
A Nassau County felony prosecution may begin with an arrest or indictment, followed by arraignment, pre-trial hearings, a possible trial, and sentencing after a conviction. At felony arraignment, the court addresses the charge and other immediate issues. Later hearings may determine whether evidence or statements can be used.
The alleged injuries, DWI evidence, prior record, and procedural history can influence how the case proceeds. Criminal proceedings and driver’s license suspension concerns require separate review because each can affect decisions made after an arrest. We address driver’s license suspension issues while evaluating the wider consequences of the case.
When DWI or DWAI allegations indicate a more serious substance use problem, we may pursue a long-term strategy involving OASAS-certified treatment programs. These programs are certified by New York’s Office of Addiction Services and Supports. Whether treatment has a role depends on the individual circumstances and available legal options.
